Miranda Rights

The Supreme Court established that under the Fifth Amendment, statements made by a suspect while in custody or being directly questioned cannot be used as evidence in trial unless the suspect was notified of their rights to remain silent. These warnings were established in Miranda v. Arizona in 1966 and upheld in Dickerson v. United States in 2020.

In 2022, the Court overturned established precedent, holding in Vega v. Tekoh that Miranda rights are “not themselves protected by the Constitution.”
